Welcome to Stayl.me. These Terms of Service ("Terms") govern your access to and use of the Stayl.me mobile application and related services ("Services"). By using Stayl.me, you agree to these Terms. If you do not agree, please do not use the Services.
1. ACCEPTANCE OF TERMS
By downloading, installing, or using Stayl.me, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are using the Services on behalf of another person, you confirm that you have the authority to bind them to these Terms.
You must be at least 18 years old to use Stayl.me. By using the Services, you represent that you meet this age requirement.
2. WHAT STAYL.ME IS — AND WHAT IT IS NOT
Stayl.me is a personal tracking tool designed to help you monitor your days of presence in New Zealand for the purpose of estimating eligibility for residency and citizenship.
IMPORTANT — Stayl.me is NOT immigration advice. Stayl.me is NOT affiliated with Immigration New Zealand (INZ), the Department of Internal Affairs (DIA), or any government agency. The calculations and information provided are estimates based on your manual inputs and publicly available immigration rules.
The decisions you make based on Stayl.me's outputs are your sole responsibility. You should always consult a Licensed Immigration Adviser (LIA), licensed under the Immigration Advisers Licensing Act 2007, before making any immigration-related decision.
3. NO IMMIGRATION ADVICE
Under New Zealand's Immigration Advisers Licensing Act 2007, providing immigration advice without a licence is illegal. Stayl.me does not provide immigration advice. The information available through the Services is for informational purposes only and does not constitute immigration, legal, or professional advice of any kind.
If you require immigration advice, please consult a Licensed Immigration Adviser or qualified immigration lawyer. You can find a list of LIAs at https://www.iaa.govt.nz.
4. YOUR RESPONSIBILITIES
When using Stayl.me, you agree to:
— Provide accurate and truthful information about your stays, visa dates, and personal details
— Verify all eligibility requirements through official sources (Immigration NZ, DIA)
— Consult qualified professionals before making immigration or residency decisions
— Keep your account credentials secure and not share them with others
— Use the Services only for lawful purposes
— Not attempt to reverse-engineer, hack, or interfere with the Services
You acknowledge that any errors or omissions in the data you enter may result in incorrect calculations, and Stayl.me bears no responsibility for such errors.
5. SUBSCRIPTIONS AND PAYMENTS
Stayl.me offers a free tier (WHV module) and premium subscription tiers. Subscriptions are managed through your Apple ID and Apple's App Store.
— You can subscribe directly from within the app
— Payment is charged to your Apple ID upon confirmation of purchase
— Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current period
— You can manage and cancel your subscription through your Apple ID settings
— Refunds are subject to Apple's refund policy. Stayl.me does not directly process refunds — please contact Apple Support for refund requests
6. INTELLECTUAL PROPERTY
All content, design, code, and functionality in Stayl.me, including text, graphics, logos, and software, are the property of the Stayl.me developer and are protected by applicable intellectual property laws.
You are granted a limited, non-exclusive, non-transferable licence to use the Services for personal, non-commercial purposes. You may not copy, modify, distribute, sell, or lease any part of the Services without prior written permission.
The name "Stayl.me", the slogan "Just Stayl", and related branding are trademarks of the Stayl.me developer.
7. PRIVACY
Your use of Stayl.me is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information. Please review the Privacy Policy to understand our practices.
8. LIMITATION OF LIABILITY
To the maximum extent permitted by law, Stayl.me is provided "as is" and "as available" without warranties of any kind, either express or implied.
The Stayl.me developer is not liable for any damages arising from your use of the Services, including but not limited to:
— Incorrect calculations resulting from user input errors
— Changes in immigration laws, policies, or regulations
— Missed deadlines, visa expirations, or eligibility windows
— Decisions made based on information provided by the Services
— Loss of data, interruption of service, or technical issues
— Any direct, indirect, incidental, consequential, or punitive damages
In any event, our total liability to you for any claim arising from your use of the Services shall not exceed the amount you have paid to us in the past twelve months.
9. CHANGES TO THE SERVICES
We may modify, suspend, or discontinue any part of the Services at any time without notice. We may also update or change features, pricing, or functionality. Continued use of the Services after such changes constitutes your acceptance of those changes.
10. CHANGES TO THESE TERMS
We may update these Terms from time to time. When we make material changes, we will notify you through the app or by other reasonable means. The updated Terms will be effective on the date indicated at the top of this document. Continued use of the Services after such changes constitutes your acceptance of the updated Terms.
11. ACCOUNT TERMINATION
You may delete your account at any time through the Settings menu. Upon deletion, your personal data will be removed in accordance with our Privacy Policy.
We may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or misuse the Services. Upon termination, your access to the Services will end immediately.
12. GOVERNING LAW
These Terms are governed by the laws of New Zealand. Any disputes arising from these Terms or your use of the Services shall be subject to the exclusive jurisdiction of the courts of New Zealand.
